Terms of Service

By accessing and using MVP English (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, regardless of whether you have a paid subscription or use the free tier.

MVP English grants you a non-exclusive, non-transferable, revocable license to access and use the Service for your personal educational purposes. This license does not include the right to:

• Resell or redistribute the Service
• Reproduce, duplicate, or copy Service content for commercial purposes
• Modify or create derivative works
• Use the Service for competitive analysis or business intelligence
• Reverse-engineer or decompile the Service

As a user, you are responsible for:

• Maintaining the confidentiality of your account credentials
• Providing accurate and current registration information
• Using the Service in compliance with all applicable laws and regulations
• Not interfering with the Service's operation or security
• Respecting the intellectual property rights of others

You are responsible for maintaining the security of your account and password. MVP Listening is not liable for unauthorized access resulting from your failure to secure your credentials. If you suspect unauthorized access, notify us immediately.

All content, features, and functionality of MVP English (including but not limited to software, audio, test materials, and educational content) are owned by MVP English, its partners, or licensors. Your use of the Service grants you no ownership or intellectual property rights.

Test materials and audio content sourced from third parties are used under license. Unauthorized reproduction or distribution is prohibited.

You may submit content (notes, vocabulary lists, messages) to the Service ("User Content"). By submitting User Content, you grant MVP English a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it for service improvement and analytics purposes.

You represent that your User Content does not infringe third-party rights and that you own or have permission to submit it.

You agree not to:

• Engage in harassment, abuse, or discrimination
• Attempt to gain unauthorized access to accounts or systems
• Upload viruses, malware, or harmful code
• Spam, phish, or engage in fraudulent activity
• Violate academic integrity (e.g., cheating on shared tests)
• Bypass security measures or attempt to break encryption
• Collect data through scraping or automated means

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MVP LISTENING DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. Test scores and progress tracking are for educational purposes and not official certifications.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MVP English SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability is limited to the amount you paid for the Service in the past 12 months, or $50 USD, whichever is greater.

You agree to indemnify and hold harmless MVP English, its officers, directors, employees, and agents from any claims arising from: (1) your use of the Service; (2) your violation of these Terms; (3) your User Content; or (4) your violation of third-party rights.

MVP English may terminate your account at any time for violation of these Terms or for any reason, with or without cause. You may delete your account at any time through your account settings.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (liability, indemnification, IP rights) remain in effect.

MVP English may update these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Your continued use constitutes acceptance of updated Terms.
